Abstract

Analisis yuridis merupakan metode pengkajian hukum secara sistematis terhadap norma, asas, dan penerapan hukum positif dalam praktik peradilan. Penelitian ini mengkaji secara mendalam putusan bebas terhadap Ketua Adat Ompu Umbak Siallagan dalam perkara konflik agraria dengan PT Toba Pulp Lestari (PT TPL) di wilayah Huta Dolok Parmonangan, Kabupaten Simalungun. Ketua Adat didakwa melakukan tindak pidana kehutanan karena dianggap membakar hutan dan menduduki kawasan konsesi perusahaan. Namun, Pengadilan Tinggi Medan memutuskan untuk membebaskan terdakwa karena tidak ditemukan unsur pidana dan karena tindakan tersebut merupakan pembelaan atas hak ulayat masyarakat adat,Penelitian ini bertujuan untuk menganalisis pertimbangan yuridis hakim dalam putusan bebas tersebut, mengaitkannya dengan teori hukum yang relevan, serta menilai dampak dan implikasinya terhadap perlindungan hak ulayat masyarakat adat dan sistem hukum agraria Indonesia. Metode yang digunakan adalah pendekatan hukum normatif dengan analisis terhadap putusan pengadilan, peraturan perundang-undangan, dan teori hukum, serta didukung oleh wawancara empiris dengan Ketua Adat dan organisasi pendamping hukum, Maka Hasil penelitian menunjukkan bahwa putusan bebas tersebut berlandaskan pada prinsip pengakuan masyarakat adat dalam Pasal 18B UUD 1945 dan Putusan MK No. 35/PUU-X/2012. Dari perspektif teori Hukum Murni Hans Kelsen, keputusan ini sah secara hierarki norma hukum. Berdasarkan teori keadilan John Rawls, putusan mencerminkan perlindungan keadilan substantif. Sedangkan teori kemanfaatan hukum Jeremy Bentham menunjukkan bahwa putusan ini berdampak positif bagi stabilitas sosial masyarakat adat dan pencegahan konflik berkelanjutan. This research provides an in-depth juridical analysis of the acquittal decision for the traditional leader of Ompu Umbak Siallagan in an agrarian conflict with PT Toba Pulp Lestari (PT TPL) located in Huta Dolok Parmonangan, Simalungun Regency. The traditional leader was charged with forestry crimes, accused of burning forest and occupying concession land. However, the Medan High Court acquitted the defendant, stating that his actions did not fulfill the elements of a criminal offense and constituted a defense of customary land rights,This study aims to examine the legal reasoning behind the acquittal decision, relate it to relevant legal theories, and evaluate its implications for the protection of indigenous land rights and Indonesia’s agrarian legal system. The research employs a normative legal method by analyzing court rulings, statutory regulations, and legal doctrines, supported by empirical interviews with the traditional leader and legal aid organizations,The findings reveal that the acquittal is grounded in constitutional principles acknowledging indigenous peoples (Article 18B of the 1945 Constitution) and the Constitutional Court Decision No. 35/PUU-X/2012. From Hans Kelsen’s Pure Theory of Law, the decision aligns with the hierarchical structure of legal norms. John Rawls’ theory of justice supports the ruling as reflecting substantive fairness, while Jeremy Bentham’s theory of legal utility highlights its positive impact on indigenous social stability and conflict prevention.
