Abstract
Probematik sengketa di sektor Ketenagakerjaan semakin dinamis, khususnya persoalan hubungan kerja Pengusaha dengan pekerja /buruh. Konflik yang sering terjadi adalah pelanggaran hak-hak pekerja/buruh oleh Perusahaan dan berujung masuk pada masalah hukum ke Pengadilan. Secara Regulasi, mekanisme penyelesaian perselisihan hubungan industrial sudah diatur melalui Undang-undang Nomor 2 Tahun 2004 tentang Penyelesaian perselisihan hubungan Industrial. Undang-undang ini menekankan pentingnya upaya musyawarah untuk mencari kesepakatan (Win-Win Solution) yaitu secara Bipartit (Buruh dengan Pengusaha) dan apabila gagal mencapai kesepakatan maka ditingkatkan ke jenjang Tripartit yaitu Mediasi yang difasilitasi Mediator dari Dinas Tenaga kerja. Mediator memiliki peranan strategis dalam mengupayakan penyelesaian sengketa antara buruh – pengusaha. Mediator memiliki kewenangan untuk memanggil dan meminta penjelasan kepada para pihak yang bersengketa, mengumpulkan bukti dan dokumen serta mengajukan solusi upaya damai dan apabila gagal mencapai kesepakatan maka Mediator diberi wewenang oleh Undang-undang untuk membuat ajuran tertulis atau yang sering disebut surat anjuran dan selanjutnya menjadi syarat formil untuk mengajukan gugatan ke Pengadilan Perselisihan Hubungan Industrial bagi para pihak yang kebeberatan terhadap isi anjuran Mediator. Maka dari persoalan diatas, Peneliti mengkaji Putusan Nomor 44/Pdt.Sus-PHI/2020/PN.Mdn dimana putusan tersebut berpedoman pada Surat anjuran Mediator Nomor: No. 560/3922/DK-2/DS/2019, sebagai alat bukti bagi Hakim dalam memutuskan perkara. Peneliti akan melakukan kajian untuk melihat sejauhmana kekuatan hukum Surat Anjuran tersebut digunakan sebagai alat bukti dan mampu mempengaruhi Pertimbangan serta Putusan pada perkara tersebut. Selanjutnya penelitian ini mengkaji bagaimana pertimbangan putusan ini dalam menilai Status Penggugat yang sebelumnya seorang Pekerja Harian Lepas dan bagaimana perhitungan berdasarkan komponen hak normatif yang harus di dapat ditinjau dari Undang undang Nomor 13 Tahun 2003 tentang Tenaga Kerja. Penelitian ini adalah penelitian hukum normatif dan di dukung penelitian empiris. Pendekatan yang digunakan adalah pendekatan undang-undang dan pendekatan konseptual. Hasil penelitian ini diketahui bahwa perselisihan hubungan industrial di pengadilan berpedoman pada surat anjuran tersebut, sebagai bukti utama dalam memeriksa dan mengabulkan gugatan Penggugat dan selanjutnya pendapat dan pertimbangan hukum Mediator yang terdapat pada isi Surat anjuran digunakan oleh Pengadilan dalam memutuskan perkara. Hal ini terjadi pada Putusan Nomor 44/Pdt.Sus PHI/2020/PN.Mdn dimana putusan tersebut berpedoman pada Surat anjuran Nomor: No. 560/3922/DK-2/DS/2019 yang dibuat oleh Mediator Dinas Tenaga Kerja Kabupaten Deli Serdang. Apabila dilihat dari putusan diatas, Peneliti berpendapat bahwa Surat Anjuran merupakan bukti surat yang memiliki nilai dan kekuatan pembuktian di Pengadilan Penyelesaian perselisihan Hubungan Industrial. Kata kunci: Mediator, Kewenangan, Surat Anjuran, Pengadilan Penyelesaian Perselisihan Hubungan Industrial ================================================================================================= The dynamics of labor disputes are becoming increasingly complex, particularly concerning the employment relationship between employers and workers/laborers. A common source of conflict is the violation of workers' rights by companies, which often leads to legal action in court. From a regulatory standpoint, the mechanism for resolving industrial relations disputes is governed by Law Number 2 of 2004 concerning the Settlement of Industrial Relations Disputes. This law emphasizes the importance of a deliberative approach to seek an agreement (Win-Win Solution) through Bipartite (between workers and employers) and, if an agreement fails, escalating it to the Tripartite level through mediation facilitated by a Mediator from the Department of Manpower. The Mediator plays a strategic role in resolving disputes between workers and employers. The Mediator has the authority to summon and request explanations from the disputing parties, collect evidence and documents, and propose peaceful solutions. If an agreement cannot be reached, the law empowers the Mediator to issue a written recommendation, often called a "surat anjuran" (letter of recommendation), which then becomes a formal requirement for filing a lawsuit with the Industrial Relations Court for parties who object to the Mediator's recommendation. Based on these issues, this researcher examines Decision Number 44/Pdt.Sus-PHI/2020/PN.Mdn, where the decision was guided by the Mediator's Letter of Recommendation Number: 560/3922/DK-2/DS/2019, as evidence for the judge in deciding the case. The researcher will conduct a study to see the legal force of the Letter of Recommendation as evidence and its influence on the considerations and decision in the case. Furthermore, this study examines the decision's considerations in assessing the status of the plaintiff, who was previously a casual daily worker, and how the calculation of normative rights was performed based on Law Number 13 of 2003 concerning Manpower. This research is a normative legal study supported by empirical research. The approaches used are the statutory approach and the conceptual approach. The results of this study show that industrial relations disputes in court are guided by the letter of recommendation, which serves as key evidence in examining and granting the plaintiff's claim. Subsequently, the legal opinions and considerations of the Mediator contained in the Letter of Recommendation were used by the court in deciding the case. This was evident in Decision Number 44/Pdt.Sus PHI/2020/PN.Mdn, which was guided by the Letter of Recommendation Number: 560/3922/DK-2/DS/2019 issued by the Mediator of the Deli Serdang Regency Department of Manpower. Based on the decision, the researcher concludes that a Letter of Recommendation is a document with evidential value and legal force in the Industrial Relations Dispute Settlement Court.
