Abstract
Pembahasan pada penelitian ini yang pertama ialah membahas tentang prosedur perceraian dan tanggung jawab hukum perdata terhadap harta bawaan suami istri berdasarkan peraturan pemerintah nomor 19 tahun 1975 pelaksanaan undang-undang nomor 16 tahun 2019 tentang perkawinan dan kompilasi hukum islam di Pengadilan Agama Rantauprapat serta membahas tentang pembagian harta bawaan suami istri yang telah bercerai berdasarkan kompilasi hukum islam di Pengadilan Agama Rantauprapat. Tujuan penelitian ini untuk dapat menjadi sumber informasi bagi pembaca khususnya dikalangan akademisi universitas labuhanbatu tentang prosedur perceraian dan tanggung jawab hukum perdata terhadap harta bawaan suami istri berdasarkan peraturan pemerintah nomor 19 tahun 1975 pelaksanaan undang undang nomor 16 tahun 2019 tentang perkawinan dan kompilasi hukum islam di Pengadilan Agama Rantauprapat. Metode penelitian yang digunakan pada penelitian ini adalah menggunakan pendekatan sosiologis atau secara langsung kelapangan. Hasil pembahasan dari penelitian ini adalah bahwa prosedur perceraian berdasarkan undang-undang nomor 16 tahun 2019 tentang perkawinan dan kompilasi hukum Islam di Pengadilan Agama Rantauprapat adalah telah berjalan dengan sesuai SOP selanjutnya bahwa pembagian harta bawaan suami istri yang telah bercerai berdasarkan undang-undang nomor 16 tahun 2019 tentang perkawinan telah diatur dalam Bab VII Pasal 35 sampai dengan Pasal 37 dan kompilasi hukum Islam telah diatur dalam dalam Kompilasi Hukum Islam terdapat pada bab XIII pada pasal sampai 85 dengan 97. Kata Kunci : Perceraian, Harta Bawaan, Kompilasi Hukum Islam ================================================================================================== The first discussion in this study is to discuss divorce procedures and civil law responsibility for the assets of the husband and wife based on government regulation number 19 of 1975 implementing law number 16 of 2019 concerning marriage and the compilation of Islamic law at the Rantauprapat Religious Court and discussing the division of the inheritance of husband and wife who have been divorced based on the compilation of Islamic law at the Rantauprapat Religious Court. The purpose of this research is to be a source of information for readers, especially among academics at Labuhanbatu University, regarding divorce procedures and civil legal responsibility for husband and wife's assets based on government regulation number 19 of 1975 implementing law number 16 of 2019 concerning marriage and compilation of Islamic law in the Rantauprapat Religious Court. The research method used in this study is to use a sociological approach or direct spaciousness the results of the discussion of this study are that the divorce procedure based on law number 16 of 2019 concerning marriage and the compilation of Islamic law at the Rantauprapat Religious Court has been carried out according to the SOP further that the inheritance of the husband and wife's assets which have been completed based on law number 16 of 2019 concerning marriage has been regulated in Chapter VII Article 35 to Article 37 and the Criminal Procedure Code of Islamic law has been regulated in the Compilation of Islamic Law contained in chapter XIII in articles to 85 to 97.
