Abstract

The first discussion in this study is to discuss the legal relationship between parking service users and parking managers, then about the form of liability for the loss of vehicles by parking managers. The purpose of this research is to be a source of information for readers, especially among academics at the Labuhanbatu University, regarding acts against the law for the loss of consumer-owned vehicles which are the responsibility of parking entrepreneurs (case study of the Glugur Rantauprapat market). The research method used in this study is to use a sociological approach or direct spaciousness. Sources of data obtained from books, journals, legislation, interviews and documentation. The results of the discussion from this study are that in legal relations for users of parking services and parking managers are like a symbiosis of mutualism, namely mutual need and benefit from one another. Between users of parking services and parking managers are bound by existing and clear laws and regulations. One of them is consumer protection laws and regulations, namely the existence of consumer protection by obtaining rights and obligations while using public parking services, for service providers and users. Furthermore, in the form of accountability for the loss of vehicles by the parking managers in the Glugur Market area, it is not yet clear who will be responsible for it. Because when confirmed by the Labuhanbatu Transportation Agency, they said that the one responsible for parking in the Glugur Rantauprapat market area was the Labuhanbatu District Industry and Trade Service. When confirmed by the Industry and Trade Office of Labuhanbatu Regency, they did not provide clear and clear information. This creates legal uncertainty for the victim who owns a missing motorbike. In the opinion of the author, rules and technical steps are needed to regulate parking in the Glugur Market. This can be done in the form of giving tickets to vehicle owners, clear parking attendants, and besides that there should be no selfishness between people or groups fighting over parking spaces which can trigger a commotion.
