Abstract

Penelitian ini bertujuan untuk untuk mengetahui Analisis Peran Keterangan Saksi Ahli Information Technology Dan Keterangan Ahli Bahasa Dalam Tindak Pidana Penghinaan Atau Pencemaran Nama Baik Melalui Aplikasi Whatsapp (Studi Putusan Nomor 994/Pid.Sus/2020/Pn Rap),seiring berkembangnya teknologi komunikasi digital, Whatsapp menjadi media yang sering digunakan untuk berkomunikasi, termaksuk dalam penyebaran ujaran kebencian ysng berpotensi melanggar hukum. Keterlibatan saksi ahli memiliki peranan penting dalam perkara tindak pidana penghinaan atau pencemaran nama baik untuk memeriksa bukti digital dalam persidangan. Dengan melihat latarbelakang diatas maka yang menjadi rumusan masalah pada penelitian ini adalah 1. Bagaimana peran dari saksi Ahli Information Technology dan saksi Ahli Bahasa dalam memberikan keterangan pada perkara tindak pidana penghinaan atau pencemaran nama baik melalui aplikasi Whatsapp? 2.Bagaimana implikasi atas keterangan saksi Ahli Information Technology dan keterangan Ahli Bahasa dalam pertimbangan putusan hakim Pengadilan Negeri Rantauprapat atas Putusan Nomor: 994/Pid.Sus/2020/PN Rap? Jenis penelitian yang digunakan adalah metode penelitian normatif dengan didukung penelitian hukum empiris, dengan sifat penelitian yang digunakan dalam penelitian ini adalah deskriptif analisis. Dengan waktu penelitian dari bulan Desember 2024 sampai April 2025. Hasil penelitian menunjukkan bahwa keterangan saksi ahli memiliki peran yang krusial. Ahli Information Technology menjelaskan aspek teknis mengenai keaslian, integritas, dan struktur meta data dari bukti digital, serta memungkinkan adanya manipulasi. Sementara itu, saksi ahli bahasa memberikan interpretasi objektif terhadap isi pesan yang dipermasalahkan, termaksuk makna kontekstual dan potensi penghinaan berdasarkan struktur bahasa. Dalam perkara tindak pidana penghinaan atau pencemaran nama baik melalui aplikasi Whatsapp, keterangan kedua ahli terbukti menjadi dasar kuat bagi pertimbangan hukum Majelis Hakim. Saksi ahli Information Technology menegaskan keaslian screenshot percakapan Whatsapp sebagai bukti elektronik yang sah, sedangkan ahli bahasa menilai ungkapan “inilah anak dari tanah sengketa” sebagai merendahkan martabat. Berdasarkan hal tersebut, terdakwa dijathui hukuman pidana sesuai ketentuan Pasal 27 ayat (3) jo. Pasal 45 ayat (3) Undang-Undang Informasi dan Transaksi Elektronik. Temuan ini menunjukkan bahwa peran saksi ahli menjadi kunci dalam membuktikan tindak pidana berbasis digital yang kompleks. Kata Kunci : Saksi Ahli Infomation Technology, Ahli Bahasa, Pencemaran Nama Baik, Whatsapp =================================================================================================== This study aims to determine the Analysis of the Role of Information Technology Expert Witness Testimony and Language Expert Testimony in Criminal Acts of Insult or Defamation Through the Whatsapp Application (Study of Decision Number 994 / Pid.Sus / 2020 / Pn Rap), along with the development of digital communication technology, Whatsapp has become a medium that is often used to communicate, including in the spread of hate speech that has the potential to violate the law. The involvement of expert witnesses has an important role in criminal cases of insult or defamation to examine digital evidence in court. By looking at the background above, the formulation of the problem in this study is 1. What is the role of Information Technology Expert witnesses and Language Expert witnesses in providing testimony in criminal cases of insult or defamation through the Whatsapp application? 2. What are the implications of the testimony of Information Technology Expert witnesses and Language Expert statements in the consideration of the Rantauprapat District Court judge's decision on Decision Number: 994 / Pid.Sus / 2020 / PN Rap? The type of research used is a normative research method supported by empirical legal research, with the nature of the research used in this study being descriptive analysis. With a research period from December 2024 to April 2025. The results of the study show that expert witness testimony has a crucial role. Information Technology experts explain the technical aspects of the authenticity, integrity, and meta data structure of digital evidence, and allow for manipulation. Meanwhile, language expert witnesses provide an objective interpretation of the contents of the disputed message, including contextual meaning and potential insults based on language structure. In the case of criminal insults or defamation through the Whatsapp application, the statements of the two experts proved to be a strong basis for the legal considerations of the Panel of Judges. The Information Technology expert witness emphasized the authenticity of the screenshot of the Whatsapp conversation as valid electronic evidence, while the language expert considered the phrase "this is the child of the disputed land" as degrading. Based on this, the defendant was sentenced to criminal penalties in accordance with the provisions of Article 27 paragraph (3) in conjunction with Article 45 paragraph (3) of the Electronic Information and Transactions Law.
