Abstract

Kasus penipuan dalam jual beli barang, termasuk jual beli mobil bekas, merupakan salah satu tindak pidana yang sering terjadi dalam kehidupan sehari-hari. Dalam transaksi jual beli mobil bekas, terdapat banyak potensi terjadinya penipuan, baik oleh penjual maupun pembeli. Penipuan ini bisa berupa penggelembungan harga, penyembunyian cacat fisik kendaraan, pemalsuan dokumen, atau penipuan identitas. Rumusan masalah dalam penelitian ini Bagaimana pertimbangan hakim dalam menjatuhkan putusan terhadap tindak pidana Penipuan Jual Beli Mobil Bekas berdasarkan Putusan Nomor 704/Pid.B/2024/PN Rap)?, dan Bagaimana mekanisme penyelesaian tindak pidana Penipuan Jual Beli Mobil Bekas dari hasil Putusan Nomor. 704/Pid.B/2024/PN Rap) ? Penelitian ini bertujuan Untuk mengetahui pertimbangan hakim dalam menjatuhkan putusan terhadap tindak pidana Penipuan Jual Beli Mobil Bekas berdasarkan Putusan Nomor 704/Pid.B/2024/PN Rap), dan Untuk mengetahui mekanisme penyelesaian tindak pidana Penipuan Jual Beli Mobil Bekas dari hasil Putusan Nomor. 704/Pid.B/2024/PN Rap). Jenis Penelitian yang dipergunakan dalam penyusunan skripsi ini adalah penelitian yuridis normatif (metode penelitian hukum normatif). Metode penelitian yuridis normatif adalah penelitian hukum kepustakaan yang dilakukan dengan cara meneliti bahan-bahan pustaka atau data sekunder belaka. Hasil penelitian ini adalah Pertimbangan hakim dalam menjatuhkan putusan terhadap tindak pidana Penipuan Jual Beli Mobil Bekas berdasarkan Putusan Nomor 704/Pid.B/2024/PN Rap) adalah menjatuhkan hukuman 3 tahun penjara terhadap terdakwa Masroh atas tindak pidana penipuan dalam jual beli mobil bekas, mencerminkan upaya peradilan dalam menegakkan keadilan dan memberikan efek jera kepada pelaku. Hakim telah mempertimbangkan bukti-bukti kuat, kerugian yang ditimbulkan, serta dampak sosial dari perbuatan terdakwa, dan Mekanisme Penyelesaian Tindak Pidana Penipuan Jual Beli Mobil Bekas Dari Hasil Putusan Nomor. 704/Pid.B/2024/PN Rap) adalah Pelaporan ke Polisi, Penyidikan oleh Kepolisian, Penuntutan oleh Jaksa, Persidangan di Pengadilan Negeri, Upaya Hukum, Pemulihan Kerugian Korban. Saran yang diperlukan dalam penelitian ini adalah Perlu meningkatkan pengawasan dan penindakan terhadap tindak pidana penipuan, terutama dalam transaksi jual beli kendaraan bermotor yang kerap terjadi secara informal, dan Disarankan untuk melakukan transaksi jual beli mobil bekas melalui jalur resmi atau menggunakan perantara yang terpercaya. In used car sales transactions, there is a lot of potential for fraud, both by the seller and the buyer. This fraud can be in the form of price inflation, hiding physical defects in the vehicle, forgery of documents, or identity fraud. The formulation of the problem in this study is How is the judge's consideration in making a decision on the criminal act of Fraud in the Sale and Purchase of Used Cars based on Decision Number 704/Pid.B/2024/PN Rap)?, and What is the mechanism for resolving the criminal act of Fraud in the Sale and Purchase of Used Cars from the results of Decision Number. 704/Pid.B/2024/PN Rap)? This study aims to determine the judge's considerations in making a decision on the criminal act of Used Car Fraud based on Decision Number 704/Pid.B/2024/PN Rap), and to determine the mechanism for resolving the criminal act of Used Car Fraud from the results of Decision Number. 704/Pid.B/2024/PN Rap). The type of research used in compiling this thesis is normative legal research (normative legal research method). The normative legal research method is a library legal research conducted by examining library materials or secondary data alone. The results of this study are the judge's considerations in passing a verdict on the crime of Used Car Fraud based on Decision Number 704 / Pid.B / 2024 / PN Rap) is to sentence the defendant Masroh to 3 years in prison for the crime of fraud in the sale and purchase of used cars, reflecting the efforts of the judiciary in upholding justice and providing a deterrent effect to the perpetrators. The judge has considered strong evidence, the losses incurred, and the social impact of the defendant's actions, and the Settlement Mechanism for the Criminal Act of Used Car Fraud from the Results of Decision Number. 704 / Pid.B / 2024 / PN Rap) is Reporting to the Police, Investigation by the Police, Prosecution by the Prosecutor, Trial at the District Court, Legal Efforts, Recovery of Victim Losses. The suggestions needed in this study are: It is necessary to improve supervision and action against criminal acts of fraud, especially in motor vehicle buying and selling transactions which often occur informally, and it is recommended to carry out used car buying and selling transactions through official channels or using trusted intermediaries.
