Abstract

Penelitian ini bertujuan untuk menganalisis konstruksi hukum dan implementasi perjanjian pembiayaan konsumen antara kreditur dan debitur mengindentifikasi faktor penyebab terjadinya wanprestasi serta penyelesaiannya,dengan studi kasus Putusan Nomor 35/PDT.G/2023/PN RAP. Metode yang digunakan Adalah penelitian yuridis normative dengan pendekatan kualitatif, mangacu pada peraturan perundang-undangan,doktrin hukum, dan putusan pengadilan terkait. Hasil penelitian menujukan bahwa penyebab wanprestasi meliputi faktor internal,kurangnya itikad baik,dan ketidak hadiran dalam proses hukum, serta faktor eksternal seperti kondisi ekonomi yang tidak stabil dan lemahnya pengawasan kreditur. Hakim dalam putusan verstek menyatakan tergugat wanprestasi berdasarkan bukti sah perjanjian pembiayaan, addemdum, dan akta jaminan fidusia yang memenuhi syarat pasal 1320 KUHPerdata. Amar putusan memerintahkan penyerahan objek fidusia atau pembayaran ganti rugi Rp 210.110.990 serta biaya perkara Rp 746.000. Penelitian ini menyarankan agar Perusahaan pembiayaan memperketat analisis debitur dan meningkatkan pengawasan, debitur memahami serta mematuhi perjanjian, dan hakim tetap cermat memeriksa bukti dalam putusan verstek. Hasil penelitian dapat menjadi referensi bagi akademisi dan praktisi hukum dalam kajian hukum dan jaminan fidusia. Kata Kunci: Wanprestasi, Perjanjian Pembiayaan Konsumen, Putusan Hakim, Jaminan Fidusia ==================================================================================================== This study aims to analyze the legal construction and implementation of consumer financing agreements between creditors and debtors, identifying the factors causing defaults and their resolution, using a case study of Decision Number 35/PDT.G/2023/PN RAP. The method used is normative legal research with a qualitative approach, referring to laws and regulations, legal doctrine, and related court decisions. The results of the study indicate that the causes of defaults include internal factors, lack of good faith, and absence from the legal process, as well as external factors such as unstable economic conditions and weak creditor supervision. In the default decision, the judge declared the defendant in default based on valid evidence in the financing agreement, addendum, and fiduciary guarantee deed, which met the requirements of Article 1320 of the Civil Code. The decision ordered the surrender of the fiduciary object or payment of compensation of Rp 210,110,990 and court costs of Rp 746,000. This study recommends that financing companies tighten their debtor analysis and increase supervision, that debtors understand and comply with the agreement, and that judges carefully examine evidence in default decisions. The results of this study can serve as a reference for academics and legal practitioners in the study of law and fiduciary guarantees.
