Abstract

Penelitian ini bertujuan untuk mengetahui tentang terjadinya sengketa yang bersumber dari perbedaan penafsiran terhadap isi perjanjian dalam pembangunan rumah antara kontraktor dengan pemilik rumah di kelurahan bagan batu kota kecamatan bagan sinembah kabupaten rokan hilir provinsi riau beserta upaya yang dilakukan dalam penyelesaian sengketa tersebut. Adapun rumusan masalah dalam penelitian ini adalah: 1) Bagaimanakah Mediasi Sebagai Alternatif Penyelesaian Sengketa Perjanjian Pembangunan Rumah Di Kelurahan Bagan Batu Kota Berdasarkan Akte Notaris Nomor :953/leg/NLL/IX/2024 ? 2.Bagaimanakah Upaya dan hambatan dalam penerapan Mediasi Sebagai Alternatif Penyelesaian Sengketa Perjanjian Kontrak Pembangunan Rumah Di Kelurahan Bagan Batu Kota Berdasarkan Akte Notaris Nomor :953/leg/NLL/IX/2024 ? Penelitian ini dilakukan dengan menggunakan metode penelitian hukum sosiologis yang menggunakan data empiris dan hasil wawancara yang dilakukan oleh penulis. Adapun Kesimpulan yang ditarik oleh penulis dalam penelitian ini yaitu: telah terjadi sengketa dalam perjanjian pembangunan rumah antara kontraktor yang mengerjakan dengan pemilik rumah berdasarkan akta perjanjian nomor :953/leg/NLL/IX/2024 Tanggal 09 September 2024 yang mana sengketa tersebut timbul dari adanya perbedaan penafsiran atas kalusul perjanjian antara pemilik rumah dengan kontraktor yang melaksanakan pembangunan, Dalam upaya penyelesaian sengketa tersebut disepakati oleh para pihak untuk melakukan addendum atas beberapa klausul perjanjian pada tanggal 09 Desember 2024 berdasarkan akta legalisasi perjanjian nomor :962/Leg/NLL/XII/2024 . Hal ini dalam praktek bilamana terjadi wanprestari maka diwajibkan membayar ganti rugi kepada pihak yang menderita kerugian. Besarnya ganti rugi tergantung pada besarnya kerugian. Dalam hal ganti rugi berupa denda. Jika terjadi suatu gangguan dan pemborong perjanjian yang bersifat teknis maupun gangguan lainnya, pada umumnya diselesaikan dengan cara damai atau melalui panitia arbitrase karena hal-hal seperti ini jarang sampai kejenjang pengadilan. Kata Kunci: Perjanjian, Penyelesaian Sengketa alternative, Mediasi ================================================================================================== This study aims to find out about the occurrence of disputes that originate from differences in interpretation of the content of agreements in the construction of houses between contractors and homeowners in Bagan Batu Village, Bagan Sinembah District, Rokan Hilir Regency, Riau Province and the efforts made in resolving the dispute. The formulation of the problem in this study is: 1) How is mediation as an alternative to dispute resolution of house construction agreements in Bagan Batu Kota Village based on the Notary Deed Number: 953/leg/NLL/IX/2024? 2. What are the efforts and obstacles in the implementation of Mediation as an Alternative to Dispute Resolution of the House Construction Contract Agreement in Bagan Batu Kota Village Based on the Notary Deed Number: 953/leg/NLL/IX/2024? This research was conducted using a sociological legal research method that uses empirical data and the results of interviews conducted by the author. The conclusions drawn by the author in this study are: there has been a dispute in the house construction agreement between the contractor who is working and the owner of the house based on the deed of agreement number: 953/leg/NLL/IX/2024 dated September 09, 2024 where the dispute arises from a difference in interpretation of the agreement between the owner of the house and the contractor who carries out the construction, In an effort to resolve the dispute, it was agreed by the parties to make an addendum to several clauses of the agreement on December 9, 2024 based on the legalization deed of the agreement number: 962/Leg/NLL/XII/2024. This is in practice if there is a default, it is obliged to pay compensation to the party who suffers losses. The amount of compensation depends on the amount of the loss. In the case of compensation in the form of fines. If there is a disruption and contract breaker of a technical nature or other disturbances, it is generally resolved by peaceful means or through an arbitration committee because such matters rarely reach the court level.
