Abstract

This study aims to understand the Legal Study of Criminal Acts of Spreading Pornographic Video Calls Through the Facebook Social Media Application in the Perspective of the ITE Law (Decision Number: 166/Pid.B/2024/Pn-Rhl). This study uses a normative legal research method using a statutory approach and a conceptual approach. Discussion Results: Criminal Liability for Perpetrators of Criminal Acts of Spreading Pornographic Video Calls Through the Facebook Social Media Application In Decision Number: 166/PID.B/2024/PN-RHL, namely in accordance with Article 45 Paragraph (1) in conjunction with Article 27 Paragraph (1) of Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Electronic Information and Transactions and Law Number 8 of 1981 concerning Criminal Procedure Law, the defendant was sentenced to imprisonment for 2 (two) years and a fine of Rp. 300,000,000.00 (three hundred million rupiah) (two) and was charged with paying court costs of Rp. 5,000.00 (five thousand rupiah). Whereas Article 27 paragraph (1) formulates: "Any person who intentionally and without the right distributes and/or transmits and/or makes accessible Electronic Information and/or Electronic Documents that have content that violates morality."
